PRIVACY STATEMENT

Jarulss Software Solutions Private Limited (“Company” aka “Neverskip”) is committed to protecting the privacy of its customers/users of its platform. Mainly the “Customers” of Neverskip are the K-12 schools or educational institutions. This Privacy Statement sets out how Neverskip may collect and use Personal Information from individuals in connection with their use of our platforms and any products or services that reference or otherwise are incorporated in this Privacy Statement (collectively “the Services”). Any reference to “we” or “us or “our” or “Neverskip” in this Privacy Statement is referred to as the Company and “you” or “your” is referred to as The Customer/User.

This Privacy Statement is published in compliance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”). The DPDP act, will come into force in a phased manner in the next six to 12 months, after: (i) an independent agency responsible for enforcing the DPDP act — the Data Protection Board of India (the Data Protection Board) — is established; and (ii) the Indian government has framed the subordinate rules (which are expected to provide interpretative guidance on procedural steps and enforcement methodology).

As the DPDP act is yet to be operational, we ensure compliance with the applicable sections of the Information Technology Act, 2000 (“IT Act”) and Rule 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (“SPDI Rules”).

Our Privacy Statement explains: (a) what Personal Information and sensitive personal data or information (“SPDI”) (for the purposes of this Privacy Statement, Personal Information and SPDI will be collectively termed as “Personal Information”) we receive from you; (b) how we collect and use that Personal Information; and (c) how we process, share and protect your Personal Information.

1. Please note that this Privacy Statement does not apply in the following circumstances

 

Existing Customers and Users: In some cases, we may access or use your Personal Information on behalf of your organization who is our customer. In such cases, we will treat your Personal Information as prescribed in the respective agreements between us and your organization, rather than as described in this Privacy Statement. Please reach out to your organization for more information on how your Personal Information is processed, or if you would like to exercise any of your data subject rights in connection with our use of your Personal Information.

2. Categories of Personal Information collected from you

 

We will only collect information about you in accordance with applicable law. The Personal Information we collect depends on the context of your interactions with us and the choices you make, including your own privacy settings and the specific services you use. Depending on your particular use, we may collect the following categories of information about you:

We collect the following Personal Information:

Personal Information Purpose of Processing
Contact information (such as name, email address, postal address) To know who you are, and verify your identity.
Age, Date of Birth and Place of Birth For verification under the age criteria the User.
Gender Used for gender analysis and support functions (like uniform fees differs for females and males, pass out ratio based on gender submitted to the government).
Nationality – To submit student ratio based on nationality to the government authorities,
– To issue Transfer certificates to students transferring from one school to another.
Personal identification numbers (such as Passport Number, National identification number, Tax identification number, Drivers Liscence number) – To help customers (schools) to automate their daily operations such as admissions, attendance, learning, payroll, etc.
– To meet our government related requirements (Personal identification numbers are pre-populated while filling exam forms for the Boards)
Heath details (such as blood pressure, diagnosis, treatments, medication) To protect the vital interest of the students, such as their allergies.

Further, we may collect:

commercial information (such as products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies);

1. Aggregated data are collected for analytical purposes.

2. any other information that you communicate to us directly during your communications with us; and

3. inferences drawn from the foregoing.

3. We limit how, and with whom, we share your Personal Information


Neverskip does not share your Personal Information with others, except for the following purposes:

a. shared with the sub-processors who provide services to enable the effective operation of Neverskip;

b. upon written request from the Customer;

c. to process or service a transaction or product authorized or requested by you;

d. when required by law to disclose such information to appropriate authorities;

e. to our professional advisers

4. We establish safeguards to help ensure the security and confidentiality of your information


Neverskip maintains physical, electronic and procedural safeguards that comply with industry standards to protect your Personal Information. We do routine tests of our information systems and website to help ensure that unauthorized access does not occur.

If you suspect any unauthorized use of your account, you must immediately notify us by sending an email to the contact details indicated in the contact section below.

5. We keep your Personal Information for as long as it is necessary to do so to fulfil the purposes for which it was collected as described above


Neverskip has measures in place such that your Personal Information, which is in our possession or under our control, is destroyed and/or anonymized as soon as it is reasonable to assume that: (i) the purposes for which your Personal Information has been collected have been fulfilled, and (ii) retention is no longer necessary for any other reason.

We may, however, retain and store your Personal Information for our legitimate business purposes (e.g. to pursue a legal action, billing purposes, etc) or as required under the law.

6. You right in relation to your Personal Information


According to the DPDP Act, the Data Subject i.e. the User of our products has the right relating to their Personal Information such as Right to access the Personal Information, right to correction of data, right to erasure of data, right to nominate, etc. Considering Neverskip is an Intermediary (Data Processor) that processes Users’ Personal Information on behalf of our customers, we encourage the Users to submit their Data subject rights directly to the Customer they are associated with.

Additionally, the Users can submit a request to exercise any of their privacy rights to us by sending a request to the information provided under “Contact” below. As Neverskip is a Data Processor, any such requests will be directed to the applicable Customers for execution unless the Customer expressly instructs us to execute the request.

7. Your Consent


The responsibility to collect express free consent from the Data Subject (Users) or the parents in case the User is a minor is cast upon the Data Fiduciary i.e. our Customers, according to the provisions of the DPDP Act.

8. Legal Basis for Processing


We rely on the (performance of) contract with the Customer (to which you are enrolled) to process your Personal Information.

9. Changes to our Privacy Statement


Without informing you, we reserve the right to update this Privacy Statement from time to time to comply with applicable laws, including as may be triggered by changes in our Personal Information processing activities, or to conform to our current business practices. If we make any material changes, we may notify you by email (sent to the e-mail address specified in your account) or through a notice on the Company’s website before the change becomes effective. We encourage you to periodically review our Company’s website for the latest information on our privacy practices.
